Lear: The Struggle that Makes History

Since the transnational company Lear at the plant in Pacheco announced the lay off of more than 100 workers and several more furloughs the workers -together with the support of many organizations- have been waging a heroic battle for the total reinstatement of all the laid-off and furloughed.

Lear's conflict deepens every day. The employers and the SMATA Union bureaucrats', protected by the repressive forces with the government's complicit silence, are striking out against the workers. Nonetheless workers and organizations fighting alongside are coming up with new ways to resist and fight for the reinstatement of the laid-off workers. Last week reflects one of the greatest struggles in recent years. This struggle has already emerged as one of the main events of national politics, wherein workers strongly and decisively face off against powerful imperialist multinationals, and become a symbol in the fight against dismissals and suspensions affecting thousands of workers.

The delegates have to be reinstated!

For the workers, the union's policies lack of any semblance of democracy. Following the threats to workers and the company's announcement on Thursday, July 17 that “if the workers' delegates are reinstated, the company will leave the country” (meaning the bosses want to decide who will be appointed as delegate), a fake assembly was carried out by the SMATA along with the company, wherein workers voted for the revocation of the delegates' reinstatement. In the morning the workers boarded the buses to go to the factory. Among them “the union guys” told them they were going to host an assembly in the capital city to dismiss the delegates. Those who refused were told "to go to the camping", meaning they would be fired. The "hostages" were conducted in this way to an "assembly without debate”, as Pignanelli –the national secretary of SMATA-, one of the two speakers of the assembly (alongside Manrique –adjunt secretary-), has said. It was there, among thugs, where workers were forced to vote. Not even the minimum statutory steps of SMATA were respected as basic rights for the delegates to defend themselves. They had sent cards as “invitations” to the assembly, which delegates received the next day. For this reason the "assembly,” outrageously undemocratic and illegal as it was, was repudiated by human rights organizations and dozens of lawyers and journalists. Even Verbitsky, from the government-friendly newspaper Pagina 12, criticized Pignanelli. Also, Ricardo Cárpena, from the newspaper Clarin, noted the aberrancy of the "assembly.” Workers responded: “The assembly is null!” and objected to the Ministry.

Popular support and "solidarity activism"

Saturday morning sun portended a warm day outside the factory. Minutes before noon the Solidary Festival that would reunite more than 1000 workers and students began outside the factory. Bands, videos at nightfall, games for the kids, solidarity potlucks, and interventions from Lear workers and organizations fighting with them would be part of this journey in a relaxed atmosphere that showed society's profound support of Lear workers. This became obvious in the delegations of the different factories and establishments arriving on the scene, all proud with the previous militancy that had fuelled the fighting fund in the campaign for "1 million pesos for Lear". A quick assembly was convened so that together with the activists, each delegation or leader could announce their contribution among cheers and applause. The entire day would end with more than 250,000 pesos gathered for the strike fund. We can proudly say that this fight will not be broken by hunger.

Another strike, another blow to the employer.

On Monday at 6:00 AM there was a new concentration at the factory's door. As part of the week's plan of action discussed in the assembly it was resolved that no one would enter the plant if the delegates were not admitted. Again, a strike at Lear was achieved. Thus began the week with a blow to the imperialist multinational.

Press Conference and Criminal Filing against Pignanelli

Pignanelli, SMATA Union general secretary, would be criminally charged with coercion of workers, due to the phony assembly on Thursday 17th, to which workers were taken against their will. In the press conference at the National Congress announcing this measure were present dozens of personalities, such as Nora Cortinas (Plaza de Mayo mother), bearing the signature of Nobel Peace Prize Adolfo Perez Esquivel. At the Ministry of Labour the comisión interna (shop steward committee) legally contested the assembly. The audio of the "assembly without debate" leaked through media outlets and, coupled with the denunciation of different workers, inveighed the gross totalitarianism that prevails in the SMATA. The bosses and the union bureaucracy fight in order to strengthen the bosses' dictatorship. The workers' plan of action echoes its enormous popular support in defence of minimum democratic rights, such as having representatives elected by workers.

The Third National Day of Struggle

In the midst of their incertitude, media outlets coined the headline “car picketing.” This would be the main “caption” of a new National Day of Struggle against Lear layoffs and dismissals across the country. The bewilderment of the Gendarmerie and the news media finding hundreds of cars blocking both lanes of the PanAmericana Highway was boundless. Cleverness defeated Berni's* policy of suppression to displace the roadblock. All the newspapers, radio stations, and television channels reflected in real time during the morning that, far from being just a “car picketing,” the vehicles were accompanied by a large mobilization with more than 500 people appearing at 6:00 AM at the door of the factory. Moreover, actions were planned and carried out in other provinces.
This Wednesday the factory stopped again. "Without delegates, the factory will not produce," activist reported. At 11:00 AM the manoeuvres of Pignanelli, who tried in various ways to defeat the measures of workers' struggle, were thwarted.
At noon, the "cars picketing" would become a caravan driving towards General Paz in opposition to the announcement of 40 dismissals and to support EMFER workers in their struggle for a better salary.
At the same time, in Plaza de Mayo, Elia Espen, Mother of Plaza de Mayo, gave her handkerchief to workers as a tribute to their fight, honouring the workers with the symbolic Mothers' handkerchief.
In the late afternoon, more than 1500 workers and students met at the Obelisco (centre of Buenos Aires city) to march to the Ministry of Labour. This day of struggle culminated with a major event at the doors of the ministry, where people, including delegates, the women's Commission, the workers of EMFER, and party leaders in support of the struggle, gave their speeches.
This new day of action had more media coverage than the ones before. It highlighted the denunciation of the bosses, who left on the street more than 200 workers; the role of SMATA and its phony assembly; and the complaints and demands that the government enforce the minimum democratic rights of the internal committee to participate in the hearings at the ministry. The great popular support, the firm activism, and militancy arising around it, with dozens of initiatives and measures of action, supports this fight as workers confront an alliance of employers, government, and the bureaucracy.
Very significant have been the many expressions of support from Lear workers that have not been dismissed to the delegates and activists–expressions that go from, greetings, to the recordings of the phony SMATA "assembly,” to gestures of defiance.

New Audience: The Struggle Continues “For the Reinstatement of all”

Secretly, as usual, a new hearing was held in the ministry to discuss the Lear workers conflict; and, as usual, it was held in the absence of the Lear workers–a ploy of the "national and popular" government. There the reinstatement of 30 workers was "resolved" and a new audience was called for Wednesday next week. No one knows at this time the names of the "reinstated," a new manoeuvre of the SMATA and the company in order to keep activists uninformed (none of the most important delegates were summoned to be reinstated). It is an achievement of the workers' struggle that the company and the SMATA have kept open the "negotiation." The slogan is clear: "Families in the street, Never Again." Here the vast majority of workers are still out because a whole shift of the most combative workers and delegates is not being reinstated. As the workers stated at the end of the meeting in the ministry, "this fight will not end until all the workers and delegates come back to their working positions." This coming Thursday a new workers assembly will determine the next steps in this struggle.

El conflicto de Lear se profundiza cada día. Los golpes que quiere dar la patronal y el SMATA, custodiados por las fuerzas represivas y en el medio del silencio cómplice del gobierno, son respondidos con nuevas acciones por los trabajadores y las organizaciones que junto con ellos estamos luchando por su reincorporación. La última semana refleja nuevamente y con mayor agudeza una de las luchas más grandes de los últimos años. Que ya se convirtió en uno de los principales hechos de la política nacional, donde los trabajadores enfrentan con firmeza y decisión a una poderosa patronal imperialista, y se fue convirtiendo en un símbolo en la pelea contra los despidos y suspensiones que afectan ya a miles de trabajadores.

¡Los delegados tienen que entrar!

Para los trabajadores no hay ni la más mínima democracia sindical. A los aprietes a los laburantes dentro de la fábrica y el anuncio de la empresa de que si entraban los delegados se iba del país (o sea, la patronal quiere decidir quién es delegado), le siguió el jueves 17 una asamblea trucha del SMATA en acuerdo con la empresa que “votó” la revocatoria de los delegados. Por la mañana los trabajadores subieron a los micros para ir a la fábrica, dentro de ellos los “muchachos” del sindicato les dijeron que iban a la sede en Capital a una asamblea para destituir a los delegados. Quién se negara “que vaya para el acampe”, o sea, sería despedido. Los “rehenes” fueron conducidos así a una “asamblea sin debate” como dijo el propio Pignanelli al comenzar la asamblea de dos oradores (él y Manrique), en donde en medio de la patota fueron obligados a votar. Ni los mínimos pasos estatutarios del SMATA fueron respetados como el básico derecho a defensa a los delegados. Llegaron a la torpe maniobra de enviar las cartas documento de “invitación” que los delegados recibieron al día siguiente. Por esto la “asamblea” escandalosamente antidemocrática e ilegal fue repudiada por los organismos de DDHH y decenas de abogados y periodistas. Hasta el mismo Verbitsky de Página 12 salió a atacar a Pignanelli y el editorial sindical de Ricardo Cárpena de Clarín tomó nota de lo aberrante de la “asamblea”. Los trabajadores respondieron: ¡La asamblea es nula! y la impugnaron ante el Ministerio.

Apoyo popular y “militancia solidaria”

El sol del sábado anunciaba una cálida jornada frente a la fábrica. Minutos antes del mediodía se comenzaba a armar el Festival Solidario que convocaría frente a la fábrica a más de 1000 trabajadores y estudiantes. Bandas de música, videos al caer la noche, pelotero para los chicos, buffet solidario e intervenciones de los trabajadores de Lear y de las organizaciones que estamos luchando con ellos serían parte de esta jornada que mostraría en un clima distendido el profundo apoyo que tiene la lucha de los compañeros. Esto se notaba especialmente en las delegaciones de las distintas fábricas y establecimientos que fueron llegando, todas orgullosas con la militancia previa que había impulsado el fondo de lucha en la campaña por “1 millón de pesos para Lear”. Una asamblea rápida se armó para que junto con los activistas, cada delegación o figuras que se acercaron a apoyar fueran anunciando su aporte entre los aplausos. Toda la jornada concluiría con más de 250.000 pesos juntados para el fondo de huelga (ver nota). Podemos decir con orgullo que esta lucha no podrá ser quebrada por hambre.

Otro paro, otro golpe a la patronal

El lunes a las 6 am hubo una nueva concentración en la puerta de la fábrica. Como parte del plan de lucha de la semana discutido en asamblea, se había resuelto que ese día nadie ingresaría a la planta si no ingresaban los delegados. Nuevamente, se logró un paro total de Lear. Comenzaba así la semana con un golpe obrero a la patronal yanqui.

Conferencia de prensa y presentación penal contra Pignanelli

Una nueva noticia recorrería los medios. Pignanelli sería denunciado penalmente por coerción hacia los trabajadores, por la asamblea trucha del jueves 17 a la que fueron conducidos los trabajadores contra su voluntad. En la Conferencia de Prensa en el Congreso Nacional que anunciaba esta medida estaban presentes decenas de personalidades, como Nora Cortiñas y llevando la firma del Premio Nobel de la Paz, Pérez Esquivel. En el Ministerio de Trabajo la comisión interna impugnaría legalmente la asamblea. El audio de la “asamblea sin debate” se filtró por los medios y, sumado a la denuncia de distintos trabajadores, están haciendo salir a la luz el burdo totalitarismo que reina en el SMATA. La patronal y la burocracia pelean por profundizar la dictadura patronal. Los trabajadores y su plan de lucha se hacen eco de un enorme apoyo popular en la defensa de los mínimos derechos democráticos, como tener representantes elegidos por los trabajadores.

Tercera Jornada Nacional de Lucha

“Piquetes de autos” titulaban sorprendidos algunos medios. Esta sería la “nota de color” de una nueva Jornada Nacional de Lucha contra los despidos en Lear y en todo el país. La sorpresa de la Gendarmería y los medios al encontrarse con que a sus espaldas un centenar de autos bloqueaba las dos manos de la Panamericana no tenía límites. El ingenio venció a la política de Berni de reprimir y desalojar cualquier corte. Todos los diarios, las radios y la tele reflejaron en tiempo real el comienzo de la jornada, que lejos de ser solo un piquete de autos fue acompañada por una gran movilización a las 6 am a la puerta de la fábrica con más de 500 personas y con medidas en distintas provincias.

Este miércoles la fábrica paró nuevamente. “Sin los delegados, no funciona la fábrica” agitaba el activismo. A las 11 de la mañana habían sido derrotadas todas las maniobras de la verde de Pignanelli, que intentó por distintas vías derrotar las medidas de lucha de los trabajadores, que incluyeron un grupo de compañeros que fue hasta donde estaban los micros de la empresa custodiados por el SMATA que fueron rodeados.

Llegado el mediodía, el “piquete de autos” se transformaría en una caravana que iría hacia la General Paz a darle apoyo a los trabajadores de EMFER en su lucha por el pago de los salarios y contra el anuncio de 40 despidos.

A la misma hora pero en la Plaza de Mayo, Elia Espen, Madre de Plaza de Mayo le daba su pañuelo a los trabajadores, como un homenaje a su lucha que la compañera honraría con el símbolo que significa el pañuelo de las Madres. (ver página 10)
Ya entrada la tarde, más de 1500 trabajadores y estudiantes se reunirían en el Obelisco para marchar hacia el Ministerio de Trabajo. La Jornada de Lucha culminaría con un importante acto sobre las puertas del ministerio, donde hablaron los delegados, las compañeras de la Comisión de Mujeres, compañeros de EMFER y los dirigentes de los partidos que apoyamos la lucha.

Esta nueva jornada tuvo mayor repercusión mediática que las anteriores. Puso de relieve la denuncia al ataque patronal que dejó en la calle a más de 200 trabajadores; el rol del SMATA y su asamblea trucha; y la denuncia y exigencia al gobierno para que permita el mínimo derecho democrático de que la comisión interna participe de las audiencias en el ministerio. El gran apoyo popular, la firmeza del activismo y la militancia que surge en torno a él, con decenas de iniciativas y medidas de acción, mantienen viva esta lucha que tiene que enfrentar la alianza de la patronal, el gobierno y la burocracia.

Un dato muy significativo han sido las múltiples expresiones de apoyo de los trabajadores no despedidos hacia los delegados y los luchadores, que van desde saludos, las grabaciones de la “asamblea” trucha del SMATA, gestos de rebeldía hacia los cambios de horario y el manoseo del transporte arbitrario que organizan la empresa y la patota para intentar burlar los piquetes. Las amenazas y los despidos no han logrado quebrar a la base “celeste”.

Nueva audiencia: sigue la lucha por “todos adentro”

En secreto, como ya es costumbre, se hizo una nueva audiencia en el ministerio: discutir sobre los obreros de Lear, en ausencia de los obreros de Lear. Cosas del gobierno “nacional y popular”. Allí se “acordó” la reincorporación de 30 trabajadores más y se convoca a una nueva audiencia para el miércoles de la semana que viene. Nadie sabe en este momento los nombres de los “reincorporados”, por lo que es de esperar nuevas maniobras del SMATA y la empresa, no sólo para dejar afuera a los activistas (ninguno de los más importantes fue convocado para ingresar) sino que incluso no hay forma de saber a ciencia cierta si la cantidades que se hablan son reales. Desde ya que de la interna y la prohibición para que entren los delegados a la fábrica no se dijo una palabra. Es un logro de la lucha de los trabajadores que la empresa y el SMATA tengan que mantener abierta la “negociación”, pero la consigna es clara: “Familias en la calle, Nunca Más”. Y aquí la enorme mayoría de los compañeros siguen afuera, porque se liquidó un turno entero y los luchadores y los delegados no ingresan. Como dijeron los trabajadores al finalizar el acto en el ministerio, “esta lucha no termina hasta que estén todos los compañeros en sus puestos de trabajo y los delegados adentro”. Una nueva asamblea de los trabajadores en lucha definirá hoy jueves los pasos a seguir.
